Cease and desist declaration

The trademark owner may assert various claims against an infringer, including claims to cease and desist. With a cease and desist declaration, the infringer contractually undertakes to refrain from using the infringing sign.

In Germany, the trademark owner only has to accept a cease and desist declaration with liquidated damages, referred to as penalty-reinforced cease and desist declaration. A cease-and-desist declaration not subject to a penalty does not eliminate the risk of legal proceedings.
